Terms of use.

The rules for using the ZumCast app, share links and this website.

Draft, not legal advice. This page is a working draft for review by a qualified lawyer before launch. Text in [brackets] is a placeholder.

Effective date: [date]. These terms are an agreement between you and [Company legal name] (“we”, “us”). By installing or using ZumCast you agree to them.

1. The app and your licence

We grant you a personal, non-exclusive, non-transferable licence to install and use ZumCast on Macs you own or control, under the plan you have (Basic or Pro). ZumCast Cloud for teams is an optional cloud add-on and is not required to use the app. Don't resell, reverse engineer (except where the law allows it), or remove notices from the app.

2. Plans and payment

Draft for legal review. The price you pay is the one shown at checkout. [Taxes, currency, payment provider and invoicing.]

2.1 Basic (free)

Basic costs nothing and has no time limit. It includes unlimited recording and editing. Exports are limited: video exports include the first half of the recording, up to 30 seconds, with a “Made with ZumCast” watermark and end card; GIFs up to 10 seconds with a watermark; screenshots with a small watermark; guides and demos up to the first 3 steps; and Zumi up to 3 plans a day. Captions files, Export all and share links are not included. [Whether and how free-tier limits can change, and the notice given.]

2.2 Pro: one-time licence

Pro is a one-time purchase, not a subscription. You pay once and receive a perpetual licence to the major version you bought (for example, version 1), including all updates to that version. There is no free trial of Pro. Pro includes share links with a cloud allowance of 5 GB, and each link stays available for 90 days. [Number of Macs per licence, licence transfer, and what happens to share links if the service ends.]

2.3 Launch pricing

At launch, Pro is sold in tiers: the first 100 customers pay $9, the next 100 pay $19, and after that the regular price is $49 (USD). The tier that applies is the one shown at checkout when you pay. [How tiers are counted (e.g. completed payments only), whether price differences between tiers are ever refunded, and what happens to refunded purchases.]

2.4 Optional major upgrades

When we release a new major version, upgrading to it is optional and costs $9 a year. You don't need to upgrade: the version you bought keeps working with everything it included, and you keep the updates for that version. [How long updates are provided for older major versions, and how upgrade renewal and cancellation work.]

2.5 Share-link storage top-up

Draft placeholder for legal review. Pro users can buy an optional storage top-up that adds 50 GB of share-link storage for 12 months, for a one-time payment of $9 (USD). It does not renew automatically. Top-ups stack, and each one ends 12 months after purchase. When a top-up ends, nothing is deleted: existing share links keep working until their own expiry date. If you are then over your allowance, new uploads are paused until you remove links or add another top-up. A refunded top-up ends at the time of the refund. Files on your Mac are never affected. [Notice before a top-up ends, and refunds for unused time.]

2.6 ZumCast Cloud for teams (optional add-on)

Draft for legal review. ZumCast Cloud for teams is an optional cloud add-on for a shared workspace. It costs $3 per person per month, billed yearly in advance ($36 per person a year). It adds a shared workspace and library, team-only links, invites by email, comments and reactions, 50 GB of storage per seat (pooled across the team), longer-lived links and seat management. Each team member uses their own Pro licence for the app; the Mac app never requires a subscription. If the add-on ends, team links stop working after the paid period; recordings on members' Macs are not affected. [Renewal, adding and removing seats mid-term and proration, cancellation, and how long team content is kept after the paid period ends.]

2.7 Refunds

[Refund policy, to be provided. Include the refund window, conditions, and how to request one, plus any statutory rights in the relevant jurisdictions.]

3. Your content

You own what you record and make with ZumCast. We don't claim any rights to it. When you create a share link, you give us permission to store and show that item to the people you share it with, only to provide the link.

You're responsible for having the right to record and share what's on your screen, camera and microphone, including other people's voices, faces and personal data. Smart redaction helps find private details but can miss things; check your video before you share it.

4. Zumi and other AI features

Zumi proposes edits and you decide whether to apply them. AI features can make mistakes, such as a wrong cut, a mistranscribed word or a missed blur. Review the result before you publish it.

5. Acceptable use

Don't use ZumCast or share links to record people without the consent the law requires, to share content you don't have rights to, or to distribute anything unlawful, harmful or abusive. We may remove share links that break these rules.

6. Pre-release versions

Beta or pre-release builds may be incomplete and may change or stop working. Keep copies of anything important.

7. Disclaimers and liability

[Warranty disclaimer and limitation of liability, to be written by counsel for the relevant jurisdictions.]

8. Ending these terms

You can stop using ZumCast at any time. We may suspend share links or accounts that break these terms. [What survives termination.]

9. Governing law

[Governing law and venue.]

10. Changes

We'll update the effective date when these terms change and tell you in the app about significant changes.
